OctaTradeX Terms of Service

1. AGREEMENT TO TERMS

1.1 Acceptance By accessing, registering for, or using OctaTradeX (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to any part of these Terms, you must immediately cease using the Platform.

1.2 Eligibility By using OctaTradeX, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into contracts
• You are not a resident of any restricted territory
• You are not subject to financial sanctions
• You will comply with all applicable laws and regulations

1.3 Changes to Terms OctaTradeX reserves the right to modify these Terms at any time. Material changes will be posted with 30 days' notice. Your continued use constitutes acceptance of modified Terms.

2. ACCOUNT CREATION & VERIFICATION

2.1 Registration To create an account, you must:

• Provide accurate, current personal information
• Create a secure password (minimum 12 characters, mix of upper/lowercase, numbers, symbols)
• Enable two-factor authentication (2FA)
• Complete KYC (Know Your Customer) verification
• Agree to our Privacy Policy

2.2 Account Verification

• Level 1 (Basic): Email verification only ($1,000 daily limit)
• Level 2 (Intermediate): ID verification ($50,000 daily limit)
• Level 3 (Full): Income/source of funds verification (unlimited access)

2.3 Account Security

• You are solely responsible for maintaining account confidentiality
• You must immediately notify us of unauthorized access
• OctaTradeX is not liable for unauthorized transactions due to your negligence
• You agree to keep your password secure and never share login credentials

2.4 Account Closure

• You may close your account anytime by submitting a request
• Remaining balance will be withdrawn within 5 business days
• Closed accounts cannot be reactivated

3. USE LICENSE & PERMITTED USE

3.1 Limited License Subject to these Terms, OctaTradeX grants you a limited, non-exclusive, non-transferable license to:

• Access the Platform
• Execute trades on available pairs
• Use automated trading bots (where available)
• Access market data and trading tools
• View your account history and transaction records

3.2 Permitted Activities You agree to use the Platform only for:

• Legitimate cryptocurrency trading
• Portfolio management
• Automated trading strategy execution
• Educational purposes (demo trading)
• Personal investment purposes

3.3 Prohibited Activities You strictly agree NOT to:

• Engage in market manipulation or insider trading
• Use bots to overwhelm server resources
• Attempt to gain unauthorized access to the Platform
• Harass, threaten, or defame other users
• Post offensive, illegal, or malicious content
• Share account access with other users
• Create multiple accounts to circumvent restrictions
• Use the Platform for money laundering or sanctions evasion
• Reverse engineer or attempt to breach security systems
• Scrape data or use automated tools without permission
• Facilitate illegal activities

4. TRADING & TRANSACTIONS

4.1 Order Placement

• All orders are executed at your request and risk
• Orders are binding and cannot be cancelled once placed
• Market orders execute at current market price (subject to slippage)
• Limit orders execute only at or better than your specified price
• OctaTradeX does not guarantee order execution at any price

4.2 Settlement

• Spot trades settle immediately
• Futures trades settle upon position closure
• Binary options settle at expiration
• All settlements are final and non-reversible except for clear platform errors

4.3 Fees & Costs

• Trading commissions: 0% (zero-fee trading)
• Withdrawal fees: 0%
• Deposit fees: 0% (payment processor fees may apply)
• Spreads: Natural bid-ask differences apply
• Leverage interest: 0.05% daily on leveraged positions
• Maintenance margin: 0.5% on margin positions

4.4 Leverage Agreement By using leveraged trading (2x-20x), you:

• Understand that leverage amplifies both gains and losses
• Accept automatic liquidation if margin falls below 0.5%
• Acknowledge that losses can exceed your initial deposit
• Accept that there are no margin calls—liquidation is automatic
• Agree to leverage limits based on your account balance and verification level

4.5 Cryptocurrency Transfers

• Deposits: Processing time 10 minutes to 2 hours (depends on blockchain)
• Withdrawals: Processing time 10 minutes to 60 minutes (crypto) / 1-3 business days (bank)
• Network fees may apply for blockchain transactions
• OctaTradeX is not responsible for delays caused by blockchain congestion

5. AUTOMATED TRADING BOTS

5.1 Bot Use Agreement By using automated trading bots, you:

• Accept full responsibility for bot strategy and configuration
• Understand that bots trade automatically without human intervention
• Accept that bots may generate losses as well as profits
• Agree to monitor bot performance regularly
• Accept that bots may malfunction or encounter errors

5.2 Bot Availability

• Bots are available on: BTC/USD, ETH/USD, BNB/USD, XRP/USD
• Bots may be paused during platform maintenance
• OctaTradeX may disable bots that violate policy
• Availability of specific bot strategies is not guaranteed

5.3 AI Guaranteed Return Plans

• Returns are calculated based on elapsed time and target return percentage
• Funds remain locked for the specified period
• Early withdrawal is not permitted
• Guaranteed returns are provided regardless of market conditions
• Plans are non-transferable and cannot be modified once activated

5.4 Demo Trading

• Demo accounts are provided for testing strategies
• Demo funds have no real value
• Demo trading performance does not guarantee live trading performance
• Demo accounts may be reset or deleted without notice

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Platform IP

• All content on the Platform (designs, logos, text, code) is owned by OctaTradeX
• You may not reproduce, distribute, or modify Platform content without permission
• Your use grants no ownership rights to any Platform materials

6.2 User Content

• You retain ownership of any trading strategies or bots you create
• OctaTradeX may use anonymized data from your trading for analytics and improvement
• You grant OctaTradeX a license to use your data to improve the Platform
• You are responsible for any intellectual property violations in your uploaded content

6.3 Third-Party Services

• OctaTradeX uses third-party data providers (CoinGecko for price data)
• We are not responsible for accuracy of third-party data
• Third-party services are used "as-is" without warranties

7. PAYMENT METHODS & FINANCIAL SERVICES

7.1 Accepted Payment Methods

• Bank transfers (ACH, wire transfer)
• Credit/debit cards (Visa, Mastercard)
• Cryptocurrency (Bitcoin, Ethereum, Tether USDT)

7.2 Payment Processing

• Payments are processed by authorized payment processors
• OctaTradeX does not store full payment details (PCI-DSS compliant)
• Fraudulent payment attempts may result in account suspension
• Chargebacks result in account closure and funds forfeiture

7.3 Refund Policy

• Deposits are non-refundable once confirmed
• Trading losses are not refundable
• Disputed charges must be reported within 60 days
• OctaTradeX investigates disputes and may reverse transactions if warranted

7.4 Not a Financial Institution

• OctaTradeX is not a bank, broker, or investment advisor
• We do not provide financial advice or recommendations
• Trading decisions are entirely your own
• Consult with a financial advisor before making investment decisions

8. DISCLAIMERS & LIMITATIONS

8.1 "AS-IS" Disclaimer The Platform is provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, express or implied, including:

• Accuracy of market data
• Uninterrupted availability
• Freedom from errors or defects
• Fitness for a particular purpose
• Non-infringement of third-party rights

8.2 Market Volatility Disclaimer

• Cryptocurrency markets are highly volatile
• Prices can change rapidly and dramatically
• Leverage magnifies volatility risk
• You can lose your entire investment
• Past performance does not guarantee future results
• No trading strategy is risk-free

8.3 Technical Disclaimer

• OctaTradeX is not responsible for:
  • Internet connectivity issues
  • Computer/device failures
  • Software bugs or glitches
  • Blockchain network delays
  • Third-party service outages

8.4 Regulatory Disclaimer

• Cryptocurrency regulations are evolving
• Your country may restrict or prohibit crypto trading
• Tax obligations are your responsibility
• Consult with tax professionals about your reporting obligations
• OctaTradeX does not provide tax advice

9. LIMITATION OF LIABILITY

9.1 Cap on Liability In no event shall OctaTradeX be liable for damages exceeding your total account balance at the time of the incident.

9.2 Excluded Damages OctaTradeX is not liable for:

• Lost profits or revenue
• Lost data or business opportunities
• Indirect, incidental, special, or consequential damages
• Any damages arising from:
  • Trading losses
  • Market volatility
  • Your strategic decisions
  • Third-party service failures
  • Force majeure events
  • Unauthorized account access due to user negligence

9.3 Force Majeure OctaTradeX is not liable for performance failures due to:

• Natural disasters
• Wars, terrorism, or acts of God
• Government actions or sanctions
• Pandemics or epidemics
• Utility failures
• Extreme weather
• Any event beyond reasonable control

10. INDEMNIFICATION

You agree to indemnify and hold harmless OctaTradeX from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any law or regulation
• Your infringement of third-party rights
• Any content you upload or create
• Any transaction you execute
• Any unauthorized use of your account
• Your interaction with other users

11. PRIVACY & DATA PROTECTION

11.1 Data Collection OctaTradeX collects and processes personal data including:

• Identity information (name, address, ID documents)
• Financial information (bank details, trading history)
• Technical information (IP addresses, browser data)
• Trading activity (orders, balances, strategies)

11.2 Data Use Your data is used for:

• Account verification and KYC compliance
• Fraud prevention
• Transaction processing
• Platform improvement and analytics
• Legal compliance and regulatory reporting
• Customer support

11.3 Data Protection

• Data is encrypted using industry-standard protocols
• Access is restricted to authorized personnel only

12. DISPUTE RESOLUTION

12.2 Formal Complaint Process

1. Submit written complaint within 30 days of incident
2. Include detailed description and supporting evidence
3. OctaTradeX investigates within 15 business days
4. Final response provided within 30 business days

12.3 Arbitration Agreement

• Disputes are resolved through binding arbitration
• Arbitration occurs in the jurisdiction specified in account registration
• Arbitration costs are split equally
• Each party bears its own attorney fees
• Class action lawsuits are waived

12.4 Governing Law These Terms are governed by the laws of the jurisdiction specified during account registration, without regard to conflict of law principles.

13. ACCOUNT TERMINATION

13.1 Termination by You

• You may terminate your account anytime
• Submit closure request through account settings
• Remaining funds will be withdrawn within 5 business days
• All trading positions will be closed
• Account data will be archived per legal requirements

13.2 Termination by OctaTradeX OctaTradeX may terminate your account if:

• You violate these Terms
• You engage in prohibited activities
• You fail KYC verification
• You provide false information
• Your activity suggests illegal use
• Court order or regulatory requirement mandates termination

13.3 Effect of Termination

• All trading access is revoked
• Remaining funds are frozen pending investigation
• Account data is retained per legal requirements
• You remain liable for any outstanding obligations

14. CHANGES TO SERVICE

14.1 Platform Updates OctaTradeX may:

• Add or remove trading pairs
• Modify available leverage limits
• Change fee structures (with 30 days' notice)
• Pause or discontinue features
• Upgrade security systems
• Modify user interface

14.2 Notice Requirements

• Material changes require 30 days' notice
• Changes are announced via email and platform notifications
• Continued use constitutes acceptance
• You may close your account if you disagree with changes

15. MISCELLANEOUS

15.1 Entire Agreement These Terms, along with our Privacy Policy and Trading Policy, constitute the entire agreement between you and OctaTradeX regarding Platform use.

15.2 Severability If any provision is found unenforceable, remaining provisions remain in effect.

15.3 Waiver Failure to enforce any provision does not constitute waiver of that provision or any other.

15.4 Assignment OctaTradeX may assign these Terms to successors or acquirers. You cannot assign without written consent.

15.5 Third-Party Beneficiaries These Terms do not create rights for any third parties.
